What is a qualified electronic signature?
A signature made with a qualified creation device using a qualified certificate bound to a verified identity. Under eIDAS it has the same legal effect as a handwritten signature in every member state. That is what separates it from ordinary e-signature tools, which produce evidence a court weighs rather than a signature it has to accept.
How is QES different from normal e-signing?
eIDAS sets three tiers: simple, advanced and qualified. Only the qualified tier gets automatic legal equivalence to handwriting. Most click-to-sign products land in the first two, which means their evidentiary strength has to be argued rather than assumed.
Does the signer need a smart card?
No, and that is the change eIDAS 2.0 brings. Wallets have to support remote qualified signing, so the signer uses the phone already in their hand. That is what makes QES workable for consumer agreements instead of only where card infrastructure already exists.
Can we verify identity and capture a signature together?
Yes, and it is the main structural advantage. The wallet holds both the identity attributes and the signing capability, so the signature ties back to an identity verified moments earlier rather than to an email address somebody typed into a form.
What about signing for a company?
Today you verify the signer as a natural person and check their authority separately. The Commission proposed a European Business Wallet in November 2025 to carry mandate credentials saying which person may act for which entity and within what scope, which would answer the signing-authority question directly. That proposal is not law yet, so plan for it rather than depend on it.
